The protection of your personal data is of particular concern to us. With this Privacy Notice, we would like to inform you about how and to what extent we process personal data as part of the application process in accordance with Regulation (EU) 679/2016 - General Data Protection Regulation ("GDPR"), the Federal Data Protection Act ("BDSG") and other applicable data protection regulations.
This Privacy Notice applies to anyone who applies to ada Learning GmbH (hereinafter also referred to as "us", "we") or shows interest in a position. It applies to internal applicants and interested parties as well as to those who wish to work for us as freelancers or independent contractors.
"Personal data" in this sense is all information that can be used to establish a connection to a person. For example, on the basis of certain characteristics that allow conclusions to be drawn about the identity (e.g. the assignment of an IP address to a specific person by querying the connection with an Internet service provider). We use the term "personal data" in this Privacy Notice as defined in Art. 4 No. 1 GDPR.

The following categories of personal data are processed as part of the application process:
Special categories of personal data may also be processed (Art. 9 GDPR). This includes, for example, data revealing health, political opinions, religious or philosophical beliefs or trade union membership.
This is the case in particular with voluntary information in an application about religion or trade union membership or with voluntary submission of photos showing the state of health (e.g. wearer of glasses).
We process the personal data specified above during the application process. This processing is in accordance with Art. 6 para. 1 lit. b GDPR in conjunction with. § Section 26 para. 1 BDSG.
Insofar as we view publicly accessible sources - such as social media profiles - this also serves to initiate an employment relationship (Art. 6 para. 1 lit. b GDPR in conjunction with Section 26 para. 1 BDSG). We ensure that we only collect data that is relevant for the establishment and implementation of the employment relationship. For this purpose, we generally use professional social media profiles (e.g. XING, LinkedIn) or websites that are related to the employment you are seeking with us (e.g. websites of your current employers or your own website, especially if you are introducing yourself to us as a freelancer).
We process special categories of personal data either:
By consciously sharing your data, you generally consent to the processing.
In the event that we are unable to enter into an employment contract with you and you agree to the further storage of your application (see details under VII.), we will process your personal data on the basis of your consent (Art. 6 para. 1 lit. a, Art. 9 para. 2 lit. a, Art. 7 GDPR).
We generally receive the data directly from you, the applicant or interested party. We may receive your data from third parties, e.g. from publicly accessible sources such as social media profiles.
You are not obliged to provide us with your personal data. If you do not do so, we may not be able to complete the application process.
As part of the application process, personal data may be passed on to internal and external third parties. Internal recipients are the HR administrators and potential future colleagues who are actively involved in the application process. We ensure that future colleagues in particular are not able to view any sensitive data from the application documents (e.g. references).
We also use several external IT service providers to operate our IT infrastructure. These are mostly processors. We have concluded corresponding order processing contracts to ensure that personal data is only processed on our behalf and in accordance with our instructions.
Parts of the data processing may take place in countries outside the European Union and the European Economic Area (so-called "third countries"). Personal data will only be processed in third countries if one of the following conditions is met:
In this way, we ensure that an appropriate level of data protection is ensured during processing.
We only store your personal data for as long as is absolutely necessary. As soon as this is no longer the case, personal data will be anonymized or deleted.
If an employment relationship is established, we will store the documents in the personnel file for the duration of the employment relationship. In this case, the data protection declaration for employees applies, which we will make available to you at the latest when the employment relationship is established.
If you give us your express consent (Art. 6 para. 1 lit. a, Art. 9 para. 2 lit. a GDPR), we will keep your application documents for a maximum of six months even after the application process has ended, if no employment relationship is established. This is so that we can contact you in the event of future suitable vacancies. You can also give this consent at the beginning of the application process, for example if you explicitly request in your cover letter that your application also be considered for future vacancies.
You have the right under the GDPR,
If we process your data on the basis of a legitimate interest, you have the right to object to the use of your data at any time (Art. 21 GDPR: Right to object). In this case, we will no longer process your personal data.
Exception:
We have grounds that override your rights or need to use your data to pursue legal claims.
Direct advertising:
If your data is used for direct advertising, you can also object to this at any time.
Right to withdraw consent:
If you have given us your consent, you have the right to withdraw your consent at any time. In this case, all data processing that we have carried out up to your revocation remains lawful. You can withdraw your consent via any communication channel, e.g. by sending an email to privacy@join-ada.com. If you inform us in this message that you no longer wish to receive emails, we will no longer send any messages to the email address you have provided.
